Alain Kyungu, a Congolese political actor, calls on the new Minister of Justice, Constant Mutamba, to urgently address the issue of rental leases in the Democratic Republic of Congo (DRC). He spoke on Tuesday, August 13, during an interview with Media Congo Press (MCP).
Kyungu highlights the main challenges faced by tenants and owners in the DRC: - the absence of formal contracts; - exorbitant rents; - abusive evictions and limited access to legal remedies.
The political actor recalls the legal provisions in force, such as Law No. 73-021 of July 20, 1973 and Law No. 15/025 of December 31, 2015, which aim to protect the rights of tenants and owners, but whose application remains insufficient.
Alain Kyungu mentions in particular the law on rent in its article 5 which stipulates: "obligation for owners to issue a receipt for each payment of rent made by the tenant". A little further in the law, we also find article 9, which prohibits rent increases without written notice of at least three months and without valid justification. In Article 12 of the same law, it is stated: "protection must be strengthened against arbitrary evictions, with strict procedures to be followed for any termination of lease.
In terms of solving the problem of rent-seekers, Alain Kyungu urges Minister Mutamba to strengthen:
- legal awareness: raise awareness among citizens about their rights and obligations regarding rent-seekers and encourage the formalization of lease contracts;
- Supervise rents and evictions: establish rent regulation mechanisms to prevent abuse and ensure fair and humane eviction procedures;
- Improve access to justice for all: facilitate access for tenants and owners to rapid and effective legal remedies in the event of a dispute.
For political actor Alain Kyungu, concrete and rapid measures are essential to improve housing conditions and strengthen citizens' confidence in the Congolese judicial system.
